Introduction
When spouses divorce and stop living under the same roof, they start paying their taxes separately. If the spouses had been together for an extended period, then the spouse with less wealth deserves to get alimony settlements from the partner. However, payment of alimony is payable only when one is alive. Property should be distinguished from maintenance, considering that property is for the inheritance, which can get allocated for children to become beneficiaries. The following feedbacks regard the client’s data analysis by two interns, Paul Panther and Stuart Student.
Feedback 1
Paul panther
The first intern, Paul Panther addressed most of the significant issues regarding the client’s data provided. However, he left out some issues which could have been handled using the given details. For instance, issues regarding Ben’s taxable income because his income is included in the details. The case and conclusion regarding Ben transferring property, home theater equipment, to Jennifer do not align with Sec 1.71-Lt (b). Therefore, Ben is not allowed by the law to give property as a means of settling alimony because alimony is payable only by cash and other related methods like bank checks or money s.
However, Ben could have sold the home theatre equipment and used the money to settle the child support and alimony for tax deductions. Alimony is a taxable income; thus, should add it to the total income for deductions. Since Ben and his former spouse live in different places, they must file tax returns independently. Alimony is payable only when the spouse is alive, and the amount can get adjusted depending on the situation. Thus, assets are not recommended for alimony. If Ben transfers the home theater instrument to Jennifer will be like giving her a gift that is not taxable and brings no loss or profit to either Ben or Jennifer. Paul’s analysis does not analyze the client’s tax liabilities and exemptions.
Feedback 2 1
Stuart Student
The second intern, Stuart Student, developed critical and detailed analysis concerning the given details regarding the legal sections of the constitution. The research is thorough and addresses the necessary issues regarding the client’s data provided. For instance, the conditions required and means of paying alimony are well analyzed and evaluated. The analysis covers the various taxable liabilities entitled for Ben. The study profoundly explains the established conclusions. Based on the analysis level, the second student, Stuart student, did the best research on the client’s details, which gives me the reasons to choose him as the qualified intern.
Conclusion
The two interns analyzed the client’s data well, although, the second intern, Stuart Student, did it better than, the first intern, Paul. Paul analyzed most of the major issues but left out some concepts. The feedback identifies the areas that Paul panther should correct and various additions to include in the analysis. It’s also advisable that Paul refers to a legal source like the constitution to get accurate analysis and facts regarding the issues. Therefore, I choose Stuart Student as the qualified intern based on the research and conclusions he made.
